Do I Need Probate?

PROBATE IS NOT ALWAYS REQUIRED and it is sometimes difficult to assess if it is required. In order to assist you we have set out below some questions and if the answer to any of them is yes then probate is probably required.

  • Is there a property held entirely in the sole name of the deceased or in part as tenants in common?
  • Did the deceased have cash savings held with financial institutions in excess of £5000?
  • Have any financial institutions asked for a Grant of Probate to release the funds?
  • Did the deceased have shares and investments held with financial institutions?
  • Did the deceased have any Pension or Life Assurance policies?
  • Did the deceased have any other assets such as foreign property, business interests or a farm?
  • Did the deceased benefit from any assets (or receive an income) held in trust on their behalf while alive?

If you have answered YES to any of the above questions it is likely that Probate will be required to be carried out on the estate.

  • Apply for the Grant of Representation and administer the estate yourself
  • Instruct a legal professional to obtain the Grant and administer the estate on your behalf
